The move isn't about the bill's substance changing, it's the calendar: Senate Majority Leader John Thune confirmed Thursday there would be no floor vote before today's recess, and the fastest realistic path back to one runs through mid-September. Congressional negotiators had circled August 7 - today, the Senate's last scheduled workday before its month-long August recess - as the day the Digital Asset Market Clarity Act needed a floor vote to have a real shot at becoming law in 2026. It didn't happen. Thune's office confirmed Thursday, August 6, that Democrats were "insistent on no Clarity vote" this month, with a spokesperson adding the bill's Senate sponsors, including Cynthia Lummis, would get it "queued up first thing when we come back." The Senate returns to Washington September 14 with three weeks left on the calendar. If Thune files for cloture before senators leave town this month, the first procedural vote could land as soon as Tuesday, September 15; if he waits until the chamber reconvenes, the earliest vote slips to Wednesday, September 16. Miss that window, and by most reporting the bill's momentum stalls into 2027 - Congress rarely revives market-structure legislation mid-cycle once a session's working weeks run out.

The price didn't fall in one move. It drifted through late July as the odds of an August vote thinned, then took two distinct steps down:

The price held a 28-32c range through most of the week reporting put the odds around 25% (down from 30% earlier that week, on uncertainty over both the remaining negotiations and the thinning Senate calendar). It then took a sharp overnight step from 22.5c to 14.5c starting 08:00 UTC on August 5, as coverage turned to the Senate running out of floor time before recess - and settled into its current range once Thune's office made the August no-vote official on August 6.

Republicans hold 53 Senate seats, so at least seven Democrats have to cross over if every Republican backs the bill - and reporting puts the realistic number at seven to nine, since a couple of Republicans are expected to oppose it on substance. As of August 5, the confirmed Democratic floor-vote count was zero: Sens. Ruben Gallego (AZ) and Angela Alsobrooks (MD), who voted the bill out of committee back in May, made their floor votes conditional on ethics language the Senate Republicans' July 22 draft didn't include, and both opposed that version. The sticking point is a provision meant to stop senior officials - President Trump, who disclosed over $1 billion in crypto-related earnings in 2025, by name - from profiting off the industry the bill would regulate. Tillis and Gallego have since sent the White House a bipartisan ethics counteroffer that would shift some enforcement to state attorneys general; the White House began engaging with it on August 5-6, but no agreement has been announced. Separate provisions on illicit finance and agriculture- market oversight remain unresolved on their own.

Two related Polymarket markets tell a consistent story. "Crypto Market Structure legislation becomes law in 2026?" - a looser question that doesn't require this exact bill text - trades a few points higher at 18.5c, pricing some chance a slimmed or renamed version still clears Congress even if the Clarity Act itself doesn't. And "Will the Senate vote on the CLARITY Act before the August recess?" has effectively already resolved: 1.1c bid / 1.2c ask on $12,794 traded, a market the calendar settled hours before this post, without waiting for August 31 to make it official.
